Narrative: On October 21, 2026, I Officer Brandon Pavao was working cruiser East-3 with my partner, Officer Priscilla Ribeiro. At approximately 8:08pm I was dispatched to 31 Calvin St. Apt. 1, for a dispute. Officer Doug Brioso (West-5) also responded. The following is a summary of the incident: Upon arrival, we were met at the front door by the reporting party Mr. XXXX and his roommates Mr. XXXX, Ms. XXXX, and Ms. XXXX. They are all roommates and live in the home with Mr. Saeb Ali Khan. Mr. XXXX stated that Mr. Khan yelled at Ms. XXXX and made her feel uncomfortable. Ms. XXXX stated that she was in the kitchen with Mr. XXXX when Mr. Khan came out of his room, walked by Ms. XXXX and told her to move out of the way aggressively. He then stood in the kitchen and starred at them. He then yelled at her to treat him like a human being and look at him, in the eyes when he walks by her. She said that she ignored him because he often yells and she ignores him until he walks away. She also stated that a couple of weeks ago he entered the kitchen while she was in there and starred at her. When she asked him what he wanted, he said that she was very beautiful. She said that interaction made her extremely uncomfortable with him. Mr. XXXX then stated that Mr. Khan walked outside, then came back in and was following her and Ms. XXXX around with his iPhone up in his face. She asked him if he was recording them and he said yes. Mr. Khan then started video recording Mr. XXXX in the kitchen, then followed him into his bedroom, where Mr. Khan was video recording him from the doorway of his bedroom. I then went inside to get Mr. Khan's side of the story about what happened today. He said he was audio recording them because he could. When we explained to him that he could not secretly, audio record them without their permission, inside a home, he said "That's your opinion, I'm gonna do what I want." I asked him for his identification and he refused. I then read Mr. Khan his Miranda Rights from a card that I carry on my person. After each right, I asked him if he understood, which he said yes. Officer Ribeiro then asked him how he was audio recording and he said that he had his phone in his pocket and was walking around the kitchen with it. He also said that he put it up on the wall of his bedroom, which is a pantry room off the kitchen, while they were in the kitchen, in an attempt to record what they were saying, for his safety. When asked about if he had also video recorded them, he said that he did, for his safety. I placed Mr. Khan in handcuffs, double locked them and checked them for tightness. I informed him that he was under arrest for Massachusetts General Law Chp. 272 sec. 99: Unlawful Wiretap. While awaiting the Prisoner Transport Wagon (Unit 200), Officer Ribeiro asked him if he wanted to allow us to listen to the recordings. He said that he did and he unlocked his phone however, when we played them, they were connected to his headphones and he refused to consent after disconnecting the blue tooth. Mr. Khan was transported to the station by Officer Derrick Dottin (Unit 200) and was booked by Lieutenant Eli Kim. Once at the station, Detectives Robert Pasqualino and Detective Sergeant Scott Whalen asked Mr. Khan if he would consent to a search of his phone for the audio recordings; he agreed. However, when they removed Mr. Khan from the cell, he refused to sign the consent and no longer wanted to consent. Officer Ribeiro entered the Iphone into SAFE as evidence and Det. Sgt. Whalen secured it the Digital Forensics Office. It should be noted that the Bail Commissioner, Mr. XXXX came to the station to bail Mr. Khan on personal however, he refused to sign the paperwork to acknowledge that he would be at court tomorrow morning. Station Officers Derrick Dottin and Alan Monaco made several attempts with him but he still refused so his bail was revoked and he will remain in custody.
Respectfully submitted, Officer Brandon Pavao #387 |
