Narrative:

On October 4th, 2026 at approximately 8:24 PM, I, Officer Benson, alongside my FTO, Keighla McAloney, were dispatched to the vicinity of Market Basket (400 Somerville Avenue) for a completed shoplifting incident. Dispatch advised that the suspect was a white male wearing a grey sweatshirt and black pants using a walker who had taken chips and beverages without paying.

Upon arrival to the area in East-4, Ofc. McAloney and I spotted a male individual matching this description walking in front of Wings Over Somerville (519 Somerville Avenue) and proceeded to stop him. The individual identified himself as Mr. Marc Nestor. I observed sitting on Mr. Nestor's walker an opened grey backpack. Tucked into the backpack were various bags of opened chips and snacks, as well as  canned beverages. Specifically, I observed an orange C-4 energy drink tucked in the side pocket of the backpack, and a can of Purple Pringles, among other consumables, piled into the mouth of the bag.

I explained to Mr. Nestor he matched the description of a suspect who'd shoplifted at Market Basket. When I asked him how he'd gotten the food and drinks in his possession, he said he'd "bought them at work." I asked Mr. Nestor for a receipt, which he stated he didn't have. At this time, Officer Neang and Detective Moreira (East-3) arrived on-scene. After advising them of Mr. Nestor's claims, Ofc. Neang and Det. Moreira went to Market Basket and spoke to the reporting party, Mr. XXXX, who advised officers that he'd witnessed Mr. Nestor taking an orange C-4 energy drink and a can of purple Pringles from the isle and did not pay, simply walking out of the store with the merchandise in-hand.

At this time, Ofc. McAloney and I took Mr. Nestor into the Wings Over Somerville lobby. I asked Mr. Nestor to be truthful about his actions, but he continued to deny responsibility and lying about how he came into possession of the goods. I gave Mr. Nestor one final opportunity to be truthful. He then admitted to Ofc. McAloney he took the merchandise without paying from Market Basket. I then asked Mr.Nestor if he had anything else in his possession, which he denied. I asked Mr. Nestor for permission to search his bag and person and he consented. While searching his person, I found an ice cream in his right jacket pocket, which he had not disclosed.

Based on available information, I placed Mr. Nestor under arrest. He was transported and booked at the station per standard.

I will be submitting a criminal complaint against Mr. Nestor for the following offense:

(266/30A/A) SHOPLIFTING BY ASPORTATION c266 S30A

The can of C-4 was returned to Mr. XXXX without issue. It's reported value was $2.50.

Respectfully submitted,

Officer Joshua Benson
