Narrative: 

On Saturday, October 17th 2026 I, Officer Santos, assigned to marked unit East 1, along with my partner Officer Barton and multiple other units were dispatched to that location. At 11:22am, I was dispatched to 151 Central Street for a fight in progress. The following is a summary of the incident:

Upon arrival, we spoke to an individual identified as XXXX who stated he was assaulted by one of his tenants. When asked to elaborate Mr. XXXX stated he was pushed and struck with a door. Mr. XXXX was then asked to describe today's events from the beginning. Mr. XXXX then informed us he came by to speak with the tenants of 151 Central Street (2nd floor) regarding rent, and was let in by a female identified as XXXX. Mr. XXXX proceeded to knock on the door of Mrs. XXXX roommate, Patrick Silva. Mr. XXXX then stated Mr. Silva opened the door and began yelling at him. An argument began regarding the rent, leading to Mr. Silva pushing Mr. XXXX approximately 4 feet back into the wall across from Mr. Silva's bedroom doorway.

When asked to demonstrate Mr. XXXX to extended both arms simultaneously multiple times in quick succession. Mr. XXXX went on to state he attempted to leave the apartment, but Mr. Silva closed the door on him striking his left leg and foot, pinning him in the threshold. Mr. XXXX then told me he was able to make his way past Mr. Silva into another room where he was subsequently able to leave through a back door stairway. I did not observe any injuries on Mr. XXXX and he declined all medical attention. I would like to note Mr. XXXX date of birth is XXXX, making him 70 years old.

I then spoke with Mrs. XXXX who allegedly witnessed the encounter. Mrs. XXXX primary language is Portuguese(Brazilian) and informed me that she let Mr. XXXX into the residence, in regards to speaking with her and Mr. Silva about rent payments. When Mr. XXXX began speaking with Mr. Silva in the doorway of his bedroom, Mrs. XXXX watched them argue about the rent payments, during the argument she saw Mr. Silva push Mr. XXXX against the wall. Mrs. XXXX then corroborated Mr. XXXX statement about being struck with the door and fleeing out the back stairwell. I would like to note Mrs. XXXX also stated she observed Mr. Silva kick and hold him and attempt to take Mr. XXXX phone multiple times. Mr. XXXX was unable to confirm if Mrs. XXXX additional statements occurred, as he was unable to remember.

We then approached Mr. Silva who had been speaking with Officer Morel (E4). Mr. Silva denied all claims of physical altercation, stating that he only held his arms up to block Mr. XXXX from leaving with his rent receipt. Officer Barton then informed Mr. Silva that based on Mr. XXXX and Mrs. XXXX statement he was being placed under arrest for A&B on a person over 60 and ABDW (Door). I then placed Mr. Silva in handcuffs and doubled locked it so it would not tighten on him.

Mr. Silva was transported by Officer Hartsgrove in unit 200 to be booked at Somerville Police Headquarters by Sergeant Teves.

Based on the information provided to me, I will be charging Patrick Silva with the following:

C. 265 S13K - Assault and Battery on person over 60

C. 265 S15A/B - Assault and Battery Dangerous Weapon on person over 60
