Narrative: 

About 5:05Pm on Tuesday, 10/13/26, I Officer Westgate in unit West 6 was approached by a citizen at the intersection of Dover St and Meacham Rd, Somerville.

The citizen mentioned that a male party appeared to be in an aggressive state and was screaming and yelling in Seven Hills Park. During the conversation I could hear screaming coming from the direction of the park. After the conversation, I began walking on Meacham Rd and could see an individual on a fence behind the MBTA Train Station. As I approached the individual I could hear him yelling and swearing as well as swinging and pushing his body weight against the fence. Not long after, I saw the chain links of the fence fall down and the individual leap off of the fence and continue to yell. I then issued commands to the individual to get down on the ground. When the individual turned, I recognized him as Matthew Podymaitis. Matthew Podymaitis's (Podymaitis) face at the time was red and his eyebrows slanted downwards. As I issued commands to him, he complied and got down on the ground. Podymaitis was then handcuffed (double locked) and informed that he was under arrest for defacement of property.

Podymaitis at the time, repeatedly stated that he should not have been arrested and instead sectioned. Afterwards, he was read Miranda warnings off of a card. I then asked him why he was acting erratic. Podymaitis stated that he was "upset about society," and mad about not being able to locate a place for his phone charger. During which he also mentioned that he told citizen in the park to "go fuck themselves," but not to any specific person. Adding, that he was first on the fence because he wanted to do a "pull up."

Previously I have interacted with Podymaitis in the Davis Square area. More so, please refer to report 26067538 where other Officers have interacted with him at Mike's Restaurant (9 Davis Sq).

Due to the intentional destruction of the fence (clear by his aggressive manner,) Podymaitis is charged with the following,

MGL CH 266 S 126A - Defacing or Damaging Property - where as Podymaitis damaged the fence that belongs to the City Of Somerville, while in an aggressive state.

MGL CH 272 S 53 - Disorderly Conduct -  Podymaitis intentionally created a risk in a public park by being agitated and thus causing alarm.

Before leaving the scene, pictures of the fence were taken and DPW was advised of the damage.
