Narrative: On Saturday, October 10th, 2026, I was working my assigned 4PM to 12AM shift in the East-3 cruiser. At around 7:45PM, I was dispatched to Buena Vista Convenience (161 Washington St), for an employee who was assaulted. Officer Derrick Dottin (East-2), also responded. The following is a summary of the incident: Upon arrival, I was met by the reporting party, Mr. XXXX. Mr. XXXX stated that he was the manager on duty, at the convenient store tonight. He stated that he stepped out of the store to get something out of his vehicle that was parked in front of the store. When he turned around to go back in the store, a male, later identified as Ms. Nelson Aguilar Martinez, kicked him on the left leg and began cursing at him. The kick did make contact with the left knee area of Mr. XXXX leg. Mr. XXXX then told Mr. Martinez that he was going to call the police. Mr. Martinez then replied with aggressive yelling and said "Fuck you," to him several times. It should be noted that Mr. Martinez was wearing thick-soled sneakers when he kicked Mr. XXXX in the leg (picture attached). Mr. XXXX also stated that he recognized Mr. Martinez because he has personally kicked him out of the store several times and told him that he was not allowed back due to him typically being intoxicated and harassing customers with aggressive behavior. When I went to speak with Mr. Martinez he began cursing at me. I informed him, at the request of Mr. XXXX that he would be trespassed from the store indefinitely. I informed Mr. Martinez that he was under arrest and to place his arms behind his back; he refused to comply at first. Mr. Martinez was placed under arrest for Massachusetts General Law C. 265 s.15A: Assault and Battery with a Dangerous Weapon. Respectfully submitted, Officer Priscilla Ribeiro #349 Somerville Police Department |
