Narrative: On 10/15/2026, I Sgt. Joseph S. Teves was working my assigned shift as the east end supervisor. I was in full uniform, and assigned to marked cruiser S-8. At approximately 17:13 hours I responded to the 350 Mart, located at 350 Broadway, within the City of Somerville, for an unwanted male party who was refusing to leave the store. I exited my cruiser and entered the store. Once inside I was able to speak with the reporting party, who would be identified as XXXX (DOB: XXXX). I asked Ms. XXXX how I could be of assistance. Ms. XXXX stated that the male party who was standing at the lottery machine was harassing customers, and workers alike. Ms. XXXX stated that she had asked this individual multiple times to leave the store, but to no avail. Ms. XXXX went on to state that the police had to respond to the store earlier in the day for the same issue, at that time the individual in question was informed that he was trespassed from the store, please see incident # 26074324. As I approached the male in question Officer Morel arrived on location to assist. I made contact with te male party who would be identified as John Potter (DOB: XXXX). I informed Mr. Potter that he was going to have to exit the store and that the manager no longer wanted him to frequent the establishment. Mr. Potter stated that he understood and that he would leave. I also informed Mr. Potter that if he were to return to the store he may be subject to arrest. Mr. Potter continued to stand at the counter without moving prompting me to verbally explain the situation to him yet again. Just as before Mr. Potter stood at the counter refusing to move. Mr. Potter then stated that he would leave the store but only after he was allowed to place his lottery bets. I informed Mr. Potter that he would need to find a different store to place his bet at and that he needed to leave the store immediately. Mr. Potter looked at me and asked if he could trust me. I replied you can trust me to place you in handcuffs, and take you into custody if you do not leave the store immediately. Mr. Potter then began asking customers in the store if they would help him out. At this point I put Mr. Potter in handcuffs and placed him under arrest. I would like to note that while placing Mr. Potter in handcuffs his right jacket sleeve prevented the handcuff from closing properly. While fixing the right handcuff Mr. Potter began yelling that he was being hurt and was requesting for someone to call the police. Once the handcuffs were secure Mr. Potter was escorted outside and transported to the station by Officer Robert Hartsgrove in the mobile detention unit (200). Mr. Potter was then booked in the usual manner by LT. Michael Capasso for the charge of Trespass Chapter 266 Section 120. Respectfully submitted, Sgt. Joseph S. Teves. |
