This report is a supplement to an incident initially investigated by Somerville Housing Authority Officer Sean Brown regarding a suspicious motor vehicle bearing Massachusetts registration XXXX, parked between 40 and 50 Memorial Road in a posted no parking area. The vehicle was reported to be running and occupied by individuals who appeared to be either sleeping or passed out.

 

I was initially responding to a parking violation when dispatch advised me to disregard that call and assist Officer Brown. Officer Brown updated dispatch that there were three occupants inside the vehicle and that the engine was running. He advised that he had attempted to wake the occupants using a flashlight without success and that he was waiting for backup prior to approaching the vehicle.

 

Upon my arrival, I observed the driver and front passenger seated inside the vehicle and appearing unresponsive. Officer Brown and I approached the vehicle and again attempted to wake the occupants using our flashlights. At that time, I observed a third male seated in the rear passenger seat behind the front passenger. Eventually, all occupants were awakened. During the interaction, the driver stated that he did not possess a valid driver's license or any form of identification. An elderly female then arrived on scene with another male and began speaking with the driver in Haitian Creole. Officer Brown requested assistance from an officer who could speak Creole, to which I did via the radio. Dispatch subsequently assigned Detective Jonathan Thermidor (DG-2) to respond.

 

The rear passenger provided a license number and stated that he had a valid permit. Officer Brown requested a license query through dispatch using his license number XXXX, which returned to Isaiah Dubuisson of Brockton with no active license. The query indicated multiple firearm charges on his BOP. Officer Brown then requested a query on the operator, who provided the name XXXX, date of birth XXXX, which returned with no record. Officer Brown later learned from the operator's mother that a false name had been provided and that the operator's true identity was XXXX, date of birth XXXX, who did not possess an active driver's license and had multiple firearm-related offenses. The occupant in the passenger seat was eventually identified as XXXX

 

Based on the use of a false name, the operator's lack of a valid driver's license, the occupant's criminal histories involving firearms, the vehicle being illegally parked, the smell of burnt marijuana and overall officer safety concerns, all occupants were ordered out of the vehicle and pat frisked.

 

Mr. Dubuisson exited the vehicle as instructed. I directed him to place his hands on the vehicle while I conducted a pat frisk. During the frisk, I felt a hard object in his left jacket pocket that was consistent with the handle of a firearm. Upon inspection, I observed the handle of a firearm poking out of his jacket. I immediately attempted to take control of Mr. Dubuisson and placed his hands behind his back. At that point, Mr. Dubuisson attempted to flee. I maintained a grip on his jacket, which came off his body, causing the firearm to fall from the jacket. I than fell, hit the pavement with my knee, causing my pants fabric to rip, and laceration to my right knee.

 

Mr. Dubuisson fled from the area between 40 and 50 Memorial Road through the courtyards toward the Somerville Housing Authority main building parking lot. He then ran through the courtyard.  of 10 Memorial Road and continued toward Temple Street. I pursued Mr. XXXX, maintained visual contact, and continuously updated dispatch with our location. As we approached Temple Street, I unholstered my firearm.

 

Mr. Dubuisson stopped running while going uphill on Temple Street, turned around, and faced me. I held my firearm at the low-ready position and commanded him to get on the ground. Mr. Dubuisson began walking toward me, and I again commanded him to get on the ground. Mr. Dubuisson then collapsed near the bike lane on Temple Street.

 

I closed the distance, holstered my firearm, and placed Mr. Dubuisson's hands behind his back. Officer Lavey III arrived on scene, and together we placed Mr. XXXX in handcuffs. Various units arrived on scene after.

 

Officer Sean Brown will be filling criminal complaints against Mr. XXXX.

 

Mr. Dubuisson was placed under arrest for the following chargers:
