Narrative:
On Sunday, July 26th 2026, while working patrol in marked cruiser, East 1, I was dispatched to a report of a man possibly passed out behind in a motor vehicle. Upon my arrival, I located a grey colored Toyota truck matching the description given by the reporting party. The truck was stopped at Lombardi St. and Broadway at a green light. With my lights on, I pulled to the left and front of the vehicle. I stepped out of my cruiser and approached the drivers side door. I observed the operator, later identified as Gerson Henriquez Munoz, slumped over at the wheel. The drivers window was down and as I stepped up to the window I detected a strong odor of alcoholic beverage coming from the vehicle. I called out to Mr. Henriquez Munoz and got no response. At this time I reached into the window to try and get a reaction to physical stimuli by shaking Mr. Henriquez Munoz's chest. Mr. Henriquez Munoz began to moan. I continued speaking to Mr. Henriquez Munoz, identifying myself as a Somerville Police officer. I attempted the physical stimulus again by shaking Mr. Henriquez Munoz's chest again. Mr. Henriquez Munoz popped his head up, looked at me, I noticed that Mr. Henriquez Munoz's eyes were bloodshot and glossy. As I began to once again identify myself as a Somerville Police officer, Mr. Henriquez Munoz cut the wheel to the left (towards me) and accelerated, striking me in the shoulder. Mr. Henriquez Munoz continued moving forward striking my cruiser, causing damage to the front and rear driver side doors, and continuing through the light, which was now red. Mr. Henriquez Munoz continued to accelerate and struck a building at the corner of Mt. Vernon and Broadway, causing damage to the building (2 Mt. Vernon St). Mr. Henriquez Munoz continued to accelerate, went through the fence of 6 Mt. Vernon Street, then struck a tree head-on causing the vehicle to stop and the airbags to deploy. I called for Cataldo Ambulance as I approached the vehicle to provide medical aid if necessary. As I made my way to the driver's side door, Mr. Henriquez Munoz was attempting to exit the vehicle. Noticing no fluids, or potential dangers, I told Mr. Henriquez Munoz to stay inside the vehicle until EMTs arrived due to potential injuries he may have received. Mr. Henriquez Munoz ignored the request and forced his way out of the vehicle. Mr. Henriquez Munoz was unsteady on his feet. I stepped in to help him keep his balance and once again detected a strong odor of alcoholic beverage on Mr. Henriquez Munoz' breath. At this time Cataldo Ambulance arrived on scene. Mr. Henriquez Munoz began stating to the EMTs, with slurred speech, he did not want to go to the hospital, and that he was not injured. The EMTs convinced Mr. Henriquez Munoz to allow them to check his vitals. While in the ambulance getting checked out Mr. Henriquez Munoz stated that he had been drinking earlier in the night. Mr. Henriquez Munoz continued to state that he was uninjured and refused further medical attention. Based on my observations throughout the call (strong odor of an alcoholic beverage, blood shot/glossy eyes, slurred speech, unsteady on his feet) I placed Mr. Henriquez Munoz under arrest for: 90/240J OUI Liquor c90 S24 265/15A/A A&B with dangerous weapon (Motor Vehicle) c265 S15A 90/24/O Reckless operation of motor vehicle c90 S24 Mr. Henriquez Munoz was transported to the Somerville Police Department by Officer T. Sullivan in unit 200. Mr. Henriquez Munoz was given SFSTs at the Somerville Police Department by Ofc. Martins. See Officer Martins Supplemental Report. During the booking process, Lt. Samir Messaoudi advised Mr. Henriquez Munoz of his rights and requested that he submit to a chemical breath test, to which he consented. Officer Martins administered the test, which produced a blood alcohol concentration of 0.18%. Mr. Henriquez Munoz was issued a notice of suspension for failing the chemical test, and his driver's license was seized. I also issued Mr. Henriquez Munoz citation #T3485746 for OUI Liquor c90 S24 and Reckless operation of motor vehicle c.90 S24
