Narrative: 

On Thursday, May 11, 2026, I, Officer Dayquan Goodnow, was working in full duty uniform for the Somerville Police, assigned to Marked Unit West 7. At approximately 1:49 AM, I was conducting a directed patrol at the West Somerville School. While doing so, I observed a black Dodge Ram pickup truck bearing MA Reg: XXXX traveling down Powder House Blvd, a public way in the city of Somerville, at a speed greater than reasonable. estimated it to be at 30 MPH in a posted 20 MPH zone. Officer Souza, West-6, responded as backup. 

I activated my emergency lights and sirens to stop the MV. The vehicle was stopped at the intersection of Curtis Street and Conwell Ave. I approached the operator, identified as Ely Mariano Da Silva. Once at the driver's side window, DA SILVA stated: "I know I messed up; I shouldn't have". I could smell the odor of an alcoholic beverage emanating from the vehicle. I further observed that DA SILVA's eyes were glassy and bloodshot red, and a green glass beer bottle was on the back passenger floor in plain view. Please note that DA SILVA had all the vehicle's windows rolled down, making it easier to observe this.

I asked DA SILVA if he had been drinking tonight, and he replied, Yes, but I only had one. Please note that as the conversation went on, I could now smell the odor of the alcoholic beverage coming off of DA SILVA's breath. DA SILVA stated that he was coming from his girlfriend's house in Watertown. Please note that, at this time, while speaking with DA SILVA, his speech was slurred.  I explained to DA SILVA that I believed that he may be operating under the influence. DA SILVA stated are you going to give me a DUI? I explained to DA SILVA that I would like to do a field sobriety test with him, which he agreed to do.

DA SILVA stepped out of his vehicle, and I could see that he was unsteady on his feet. I explained to DA SILVA that we were going to move from Curtis Street to Conwell Ave, which was flat and had a crosswalk we could use for the series of tests. I asked DA SILVA if he had any medical conditions before conducting the test he stated no. 

I would note that prior to each test, directions were given. Demonstrations were given for the walk and turn test and the one-leg stand.

The first test was the Horizontal Gaze Nystagmus (HGN):

I explained to DA SILVA that he would follow the stimulus, which was my right index finger, with his eyes without moving his head. Once I began, DA SILVA immediately followed my finger with his head going to his left. I reexplained to DA SILVA that he only needed him to follow my finger with his eyes without moving his head. On the second attempt, DA SILVA began moving his eyes to his left while my finger remained at the starting position. I explained to DA SILVA not to try to anticipate where my finger would go and to wait until I began the test. On the third attempt, I began moving my finger to the right to observe a lack of smooth pursuit, and he immediately began moving his eyes rapidly from left to right, stating he was having trouble following my finger.

The second test was the Walk and Turn:

The area of the street used for the tests was flat, dry, and clear of debris. The area was well-lit. The line used for this test was the white line at the crosswalk. During the instructional phase of this test, DA SILVA was unsteady on his feet. I demonstrated the test to DA SILVA and asked him to get into the starting position and wait until I told him to begin. As DA SILVA was in the starting position, he was unable to keep his hands at his side and attempted to use them for balance. Before my instruction to start the test, DA SILVA began on his own. I asked him to return to the starting position. DA SILVA returned to the starting position and was instructed to start, but he was unable to stay on line and walked off line on the second step. Note: DA SILVA took 10 steps, looked at me, and stated, I don't know how many I've done. DA SILVA did not perform the series of small steps to turn around and walk back heel-to-toe.

Please note that in total, I observed DA SILVA walk off line on step two. He was unsteady, failing to keep his arms down at his side, failing to keep his feet heel to toe, failing to count out loud the number of steps, taking too many steps, and failing to complete the turn around and walk back heel to toe.

The third test was the One-Leg Stand:

I demonstrated the test to DA SILVA, who refused to proceed, stating he was too nervous to conduct the test.  

I placed DA SILVA into custody (DL) and explained to him that he was under arrest for operating under the influence of alcohol. I request the Prisoner Transport Vehicle (Unit 200) to respond to my location for transport.

Unit 200 arrived, operated by Officer Rivera, and DA SILVA was transported to the Somerville Police Department and booked by Lieutenant Samir Messaoudi.

During the booking process, Lieutenant Messaoudi advised Da Silva of his rights and asked him to submit to a chemical test of his breath to which he agreed. Officer Souza interpreted for DA SILVA from English to Brazilian Portuguese. Officer Antoine administered the test to DA SILVA, with a test result of 0.16% BAC. DA SILVA was issued a notice of suspension for a chemical test failure, and his license was seized.

I issued DA SILVA MA Uniform Citation 238958AE for operating a motor vehicle while under the influence of alcohol and open container of alcohol. All documentation will be placed into evidence. The vehicle was towed by Stephen's tow, and a 12-hour hold will be placed on it.
