Narrative: 

On Sunday, May 17, 2026, I, Officer Dayquan Goodnow, was working in full duty uniform for the Somerville Police, assigned to Marked Unit West 7. At approximately 1:49 AM, I was traveling on Holland Street, a public way in the city of Somerville, and I observed a Black Mercedes bearing MA: XXXX blocking the bus lane. I queried the plate and learned that the vehicle's inspection sticker had also expired. I activated my emergency lights and sirens to stop the MV. While in my cruiser, I could see that there were three people in the car, including the driver.  I observed them all begin to move nervously around the vehicle, with the front-right passenger looking back at me several times. Officer Souza, West-6, responded as backup.

I approached the operator, identified as Anthony Fallano III, and immediately smelled the odor of an alcoholic beverage emanating from the vehicle. I observed that FALLANO's eyes were bloodshot red and glassy. I explained the reason for the stop and asked FALLANO where he was going. He stated he was going back home to Malden and that he was just picking up his friend, who was in the back passenger seat.

I asked FALLANO if he had been drinking tonight, and he replied No. I explained to FALLANO that I believed that he was under the influence. FALLANO immediately replied No again and stated that he had not been drinking. I asked FALLANO if there was anything in the vehicle that officers should know about, and he stated No you can search it.  I asked FALLANO to step out of the vehicle and, if he was willing to take a field sobriety test, he stepped out and stated No. I explained that I believed that he was under the influence of alcohol. FALLANO stated Officer, I'm talking to you normally, though. Please note as FALLANO stepped out of the car, the odor of an alcoholic beverage became stronger. During our conversation, I could smell a strong odor of an alcoholic beverage coming off of FALLANO's breath due to us being in closer proximity. 

I conducted a search with FALLANO's consent and inventoried the vehicle for the tow. The vehicle was towed by Stephen's Towing, with the approval of Sergeant Scrugli, Sierra-9. 

I placed FALLANO under arrest (DL) and explained to him that he was being charged with operating a motor vehicle while under the influence of intoxicating liquors. I requested the Prisoner Transport Vehicle (Unit 200) to respond to my location for transport.

Unit 200 arrived, operated by Officer Rivera, and FALLANO was transported to the Somerville Police Department and booked by Lieutenant Samir Messaoudi.

During the booking process, Lieutenant Messaoudi advised FALLANO of his rights and asked him to submit to a chemical test of his breath, to which he refused. FALLANO was issued a notice of suspension for refusal to submit to the chemical test, and his license was seized.
