Narrative: 

 

On August 1, 2026, at approximately 5:22 AM, I, Officer Daniel Dell'Isola, assigned to cruiser E3, responded to 37 Columbus Ave apt #2 for a report of a dispute between two neighbors.  The reporting party, who was later identified as XXXX, stated that his downstairs neighbor, later identified as Decio Pereira De Oliveira, entered his apartment and began pushing XXXX out of his room.  XXXX informed Somerville Police dispatch that Decio sprayed pest control spray and him and then took off downstairs to his apartment on the 1st floor.  Officer Lentini responded as backup.

When officers arrived on scene, we spoke with XXXX.  As we entered the apartment, I noticed a form of liquid on the floor of the hallway in front of XXXX room that was leading towards the kitchen.  In the kitchen was also a splatter of blood.  XXXX didn't have any noticeable injuries and I asked him if he needed medical attention to which he stated no.  XXXX explained to me that he has been having issues in his apartment since moving in approximately 2 months ago.  XXXX stated that none of the utilities in the apartment are working and due to this, he refused to pay his rent. XXXX explained to me that Decio is not the landlord, however he collects the rent for the landlord.  XXXX stated that Decio lives on the first floor of the building, which is a separate apartment form the second floor.  

XXXX stated that this morning, Decio entered his apartment unannounced and confronted XXXX on not paying his rent.  XXXX stated that Decio began pushing him out of his room.  XXXX then stated that Decio grabbed a knife, a pest control bottle and sprayed XXXX with the pest control.  XXXX showed us the pest control container which was located in the kitchen.  XXXX stated that while Decio was holding the knife in his left hand, Decio struck XXXX with the spray nozzle of the pest control container.  XXXX stated that he then began calling 911 and Decio fled downstairs, through the back door located in the kitchen, to his first floor apartment.  I asked XXXX who's blood that was on the kitchen floor to which he stated that it was Decio's.  XXXX then explained that after being sprayed and struck with the nozzle of the pest control, he struck Decio in the face with a closed fist in an attempt to defend himself.  I noticed a butter knife located on the stove in the kitchen.  I asked XXXX if that was the knife that Decio was holding, to which he stated he wasn't sure and that Decio still may have a knife in his possession.  I then requested for more units to arrive on scene before going downstairs to speak with Decio.  Lt. Messaoudi, Ofc. Kartso, and Ofc. Antoine responded.  

Officer Lentini and I went down the back stairwell to the first floor apartment to speak with Decio.  We knocked, announced our presence, and were greeted at the door by Decio.  Decio's primary language is Brazilian Portuguese.  I requested for Officer Bittencourt to arrive on scene for translation.  All statements documented in the report from Decio were translated by Ofc. Bittencourt.  I asked Decio where he was bleeding from  and he showed me the inside of his lip which had a laceration.  I asked Decio if he needed medical attention to which he declined.  I then asked Decio what happened this morning and he stated that XXXX has not paid his rent and was told from the landlord that he has been evicted from the apartment.  I asked Decio if the landlord provided him with any copies of the eviction notice or any official court documents stating that XXXX has been evicted, to which Decio stated no.  It should be noted that all of XXXXs belongings, including his bed and bedroom furniture were still in his bedroom.  Decio stated that he heard noise coming from the upstairs apartment and believed that it was coming from XXXX's room.  It should be noted that XXXXs room is not located directly above Decio's room.  It also should be noted that there are numerous other residents that reside in the second floor apartment.  Decio stated that he was under the impression that no one should be in XXXX's room, so he entered the apartment to check it out.  I asked Decio how he entered the apartment and he stated that the landlord provided him with keys.  I asked Decio if he contacted any of the residents in the second floor apartment prior to entering,  to which he stated no.  Decio then stated that he noticed XXXX was inside the apartment and he confronted XXXX telling him to leave.  Decio stated that XXXX then struck him in the face with a closed fist.  I asked Decio if at any point did he grab a knife during the altercation, to which he stated yes.  I asked him to describe the knife and its location.  Decio stated that it is a knife used by the residents to pry open the back door incase they get locked out and it was located upstairs in the kitchen.  I then went and grabbed the butter knife from the kitchen in the second floor apartment, showed Decio it and asked if this was the knife to which he stated yes.

Based off the statements and evidence presented to me, I informed Decio that he was under arrest.  I placed Decio in handcuffs (double locked) and requested for unit 200 to arrive on scene for transport.  Ofc. Bittencourt read Decio his Miranda Rights from a card that I carry on my person.  Decio was transported to the Somerville Police Station by Ofc. Martins and booked by Lt. Isidoro.  I will be charging Decio with Assault with a Dangerous Weapon (knife) Massachusetts General Law Ch. 265 s. 15B/A, Assault with a Dangerous Weapon Massachusetts General Law Ch. 265 s. 15A/A, and Breaking and Entering Night Time for a Felony Massachusetts General Law Ch. 266 s. 16/A.

I confiscated the knife and will be submitting it into evidence.
