Narrative: 

While working the Day Shift assigned to marked unit West 7 on Saturday, June 13, 2026, at approximately 11:25 AM, I responded to 37 Kingston St, for a report of a break and entering.  Marked Unit West 5 (Officer Al Gee) also responded.

Upon arrival we were met by reporting party, XXXX. Mr. XXXX is a real estate agent, who was getting the apartment ready of an open house.  When Mr. XXXX entered the apartment, he discovered what appeared to be a male party sleeping in a third floor bedroom.  He then stepped out, and called 911.  Mr. XXXX stated that he is not sure if the entrances to the apartment were secured, though they should have been.

Officer Gee and I conducted a search of the apartment, and discovered a female party identified as, Shineya Smith, and a male party identified as, Derek Lydon, sleeping in the indicated bedroom.  When questioned about their presence at the residence, Mr. Lydon stated that last night he was feeling cold, and found his way into the apartment to get some sleep.  He stated that the door was unsecured, and believed he did not enter and break into the apartment. Neither Ms. Smith or Mr. Lydon were in possession of an ID.  Mr. Lydon was identifed by his Social Security number, and Ms. Smith was identified by name and date of birth, as the initial social security number she provided, did not yield any results.

Both parties were informed that they were being placed under arrest for the crime of 266/16A, B and E NIGHTTIME FOR FELONY.  They were transported to the station at 220 Washington St. by unit 200, and booked per usual manner by the shift commander, Michael Capasso.
