The following is a summary of the details related to this incident.
On Monday, August 4, 2025, I, Officer David Ruf, was in full-uniform and assigned to marked cruiser East-3, for the Somerville Police Department. At approximately 3:27 A.M., Officer Martins (East-2) and I were dispatched to 144 School Street for a check condition.
Upon arrival Somerville Fire was already on the scene and the defendant, Sheser Gurung, was standing outside the vehicle. It was reported that Mr. Gurung's legs were hanging out of the vehicle, but the car was off on the originally. I observed Mr. Gurung walk back and forth from the driver's door to the trunk area several times and when he did so, he was very unsteady on his feet. His speech was also slurred and his eyes appeared to be glassy and bloodshot. I attempted to inform Mr. Gurung that his vehicle was going to be towed due to it not being legally parked. He then stated to me several times that he was just trying to go home. At one point he also stated that it was a "Tuesday night. I informed him that I believed that he was under the influence and not to attempt to drive the vehicle. He stated that he was "was drunk, so what he didn't hurt anyone." Several times he went in and out of the vehicle believing that he was retrieving property to walk him. He then go into the driver's seat and started the vehicle. Officer Martins and myself then attempted to get Mr. Gurung out of the driver's seat. He was holding onto the steering wheel and at one point hit the gas. Officers were then able to get him out of the vehicle and placed him in handcuffs for officer safety. I asked Mr. Gurung to take field sobriety test and he refused. I informed him that he was now under arrest for OUI Liquor. I would like to note that School Street is a public way located in Somerville defined by the commonwealth of Massachusetts.
Mr. Gurung was charged with the following offenses;

M.G.L c268 / §32B RESISTING ARREST
Mr. Gurung was transported by Unit #200 (Officer O'Leary) to Somerville Police Headquarters. It should be noted that while waiting to get into the prisoner transport wagon, Mr. Gurung asked Officer Martins why we were messing with him. Mr. Gurung believed that we conducted a motor vehicle stop on him. Officer Martins informed him the we got dispatched to a check condition, but he still believed that he was pulled over. During the booking process Lt. Kim asked Mr. Gurung to submit to a chemical test of his breath. He took the test and his results were a .15%, nearly two times the legal limit. I issued Mr. Gurung uniform citation #T3312171 for the above-mentioned offense and placed it with his property.
