Narrative: 

On 9/3/2026, I, Officer McCune, was assigned to marked unit East-1 working for the Somerville Police Department. At approximately 8:59 PM, Officer B. Pavao (East-3) and I were dispatched to 335 Revolution Dr. (MGH outpatient care) regarding reports of an intoxicated valet.

     Upon arrival, I met with the police security officer XXXX. Mr. XXXX explained that he had received reports from a few employees about a valet, Angel Barrios, being intoxicated. Mr. XXXX told me that Angel was no longer welcome at work and needed to leave the property and go home. In hopes of helping Mr. Barrios, Mr. XXXX told me he offered to park Mr. Barrios' vehicle (MA. Reg XXXX) in the garage and arrange for someone to pick him up and get him home safely. I asked Mr. XXXX what made him suspicious that he was intoxicated and he stated that he observed him being unsteady on his feet; he was acting unusual. He also noted Mr. Barrios had a strong odor of alcohol coming from his person.

     I then made contact with Mr. Barrios and asked him what was going on tonight. Mr. Barrios told me that his work believed that he was drunk, but he stated that he did not have anything to drink tonight. I want to note that throughout my encounter with Mr. Barrios, I noticed several possible signs of impairment, such as Glassy eyes, unsteadiness on his feet, and a strong odor of alcohol coming from his person. To ensure that a medical emergency was not occurring, I asked Mr. Barrios if he had any medical conditions, such as diabetes, that could potentially be causing his unusual behavior, and he stated that he did not. After conversing with Mr. Barrios, I was uncomfortable allowing him to operate a motor vehicle based on my observations. I explained to Mr. Barrios that this was for his safety and the safety of other citizens on the roadways. Mr. Barrios was adamant that he was fine and would drive home. When officers told him this was not going to happen, he began to insult officers. For approximately 40-45 minutes, I offered Mr. Barrios multiple transportation options to his residence, which is in the Mystic housing projects, only 5 minutes away from Assembly Row. After offering to order Mr. Barrios an Uber or provide courtesy transport home, he contacted his friend XXXX, who stated he would pick up Mr. Barrios' vehicle and drive him home. At one point, Mr. Barrios was allowed to return to the vehicle to retrieve an item, and that is when I noticed, in plain view, an empty nip bottle in the back seat directly behind the driver's seat. Officer Pavao also found another empty nip in the side compartment of the driver's side door. While officers continued to wait for Mr. XXXX to arrive, Mr. Barrios would attempt to walk away from us.

     Finally, Mr. XXXX arrived on scene and was ready to take Mr. Barrios home. At this point, after being advised he was no longer welcome at work, Mr. Barrios entered the building to use the bathroom. I then entered the building with Mr. XXXX, and Mr. XXXX again advised Mr. Barrios that he was no longer welcome on the property and needed to leave. I also advised Mr. Barrios that he was not welcome and needed to leave the property. Mr. Barrios refused to leave the property. After being on scene for approximately one hour and exhausting all techniques of de-escalation, Mr. Barrios was placed in handcuffs by Officer Pavao and me. We then escorted him out of the building. While outside, he continued his disruptive behavior, and I informed him he was being placed under arrest for trespassing. I contacted Somerville Police Dispatch and requested unit-200 (Officer Khoury) to the scene. While waiting for the prisoner transport vehicle, Mr. Barrios continued his resistance by pulling and pushing away from us; we eventually sat Mr. Barrios down on the curb outside the building. I attempted to read Mr. Barrios his Miranda Warnings but was unsuccessful due to his disruptive behavior. Unit-200 eventually arrived on scene, and Mr. Barrios continued his resistance as officers were attempting to place him in the prisoner transport vehicle safely. Because of Mr. Barrios's behavior, officers had to lift him and physically place him in the seat. Mr. Barrios was subsequently transported back to the Somerville Police Station.

     After Mr. Barrios was transported, I spoke with multiple other employees identified as XXXX and XXXX. Both Mr. XXXX and Ms. XXXX stated that at different points during their interactions, he was slurring his words and unsteady on his feet. I also learned from Mr. XXXX that Mr. Barrios' manager, XXXX, had been contacted about the situation and did not want Mr. Barrios at work any longer. According to Mr. XXXX, Mr. XXXX spoke with Mr. Barrios and advised him of this as well.

     Mr. Barrios is being charged with the following:
