Narrative: On Tuesday, September 1, 2026, at approximately 12:17 PM, I, Officer Richard Lavey III, was working in marked cruiser East 4 when I was dispatched to Speedway on Mcgrath highway for a patron causing a disturbance. Upon arrival, I spoke to XXXX. XXXX stated a man with a bicycle and blue backpack came into the store and started causing a disturbance. He started yelling and when asked to leave, he threw a gallon of milk at XXXX. XXXX stated he moved out of the way at the last second and the party left the store. XXXX stated he has had repeated issues with this party over the course of the last few weeks. XXXX wanted this party trespassed and believed he saw him walk down Broadway towars the liquor store. XXXX also provided a video of the incident. The individual in the video is the same individual from incident 26061613 where he stole a package from the porch of XX Grant St. While searching for this individual, Officer McCune, who was working the voting station, called me stating he had an individual matching the description coming out of 12 Fellsway West walking towards Broadway. I was there shortly and stopped this individual who was then identified as Michael FORSTER. FORSTER gave me fake names and a fake social security number but Officer McCune recognized FORSTER and confirmed he had an active warrant. While speaking to FORSTER, he pulled out a bottle of alcohol in a brown paper bag and starting chugging it. I took the bottle away from him and dumped it out. When first speaking to FORSTER he stated nothing happened, and after confronting him with the story XXXX told me, he stated XXXX had assualted him and he had been giving him a hard time about bringing his own cup into the store to get soda. When told XXXX had the entire incident on video, FORSTER said "okay." FORSTER asked if he was in trouble and I informed him he was being arrested. The video of the incident was emailed to Officer Martins. FORSTER will be charged with assault with a dangerous weapon as well as larceny under $1200 dollars for incident 26061613.
