Narrative: 

On 9/5/26 I was working Patrol in cruiser E2 on an evening shift. At around 2337 OFC D Ruf (E3) and I were sent to Beacon ST at Park ST for a motor vehicle accident with injury.

I arrived to find two vehicles involved. I spoke to a witness; Ms. XXXX. She reports being in her car, traveling west on Beacon ST approaching the light at Park ST. She witnessed the striking vehicle (V1), a silver Mercury Marine take a left onto Beacon ST from Park ST at a high rate of speed, go over a curb and strike the vehicle in front of hers (V2), a Nissan Versa. Her vehicle was not involved.

I checked on the driver of the struck vehicle; Mr. XXXX. He reports approaching the light at Park ST while traveling west on Beacon ST when his car was struck on the drivers side. He refused medical. I called for two tow trucks.

I then spoke to the driver of V1; Mr. D Labraico. He reports that he was taking a left from Park ST onto Beacon ST when he overshoot the turn and hit V2. I noted an odor of an alcoholic beverage coming from his person. I asked him how much he had to drink tonight. He replied that he had two beers, both "Miller Lite" but that it was "hours" ago. While speaking to him I also noted that he was unsteady on his feet and had glassy eyes. His speech was somewhat slurred and he seemed to have trouble following simple instructions. I asked him several times to give me his ID, which he was never able to do. I allowed him back into his car because he said his ID may be inside. He just sat on his drivers seat and seemed to fumble around. I got him back out of the car and onto the sidewalk. At this point I told him that I suspected him of OUI and asked him if he wanted to do some field sobriety tests. He refused and I placed him under arrest. EMTs began to check him out and Mr. Labraico requested to go to the hospital. An EMT asked Mr. Labraico what city we were in and he replied "Cambridge." He suffered a bloody nose and had hit his head in the crash. We went to MGH. At MGH he told medical staff that he smoked weed at some point prior to the crash. Medical staff was aware he was in custody for OUI and at no point did I hear his refute this to medical staff while they were asking him questions. At one point, an attending med student asked Mr. Labraico if he knew where he was (physical location/hospital name) that moment and Mr. Labraico replied "im ok." While sitting in his hospital bed he said to me "I fucked up man." I was relieved by OFC V Romero (LH SE.)

Both cars were towed. I will be completing a crash report. I issued citation number 528682AE to Mr. Labraico for 90/24 (OUI Liquor). It will be placed in his property. Mr. Labraico returned back to the station at around 0311 where he was booked. During the booking process, Lt. Samir Messaoudi advised him of his rights and requested that he submit to a chemical breath test, to which he consented. Officer V Romero administered the test, which produced a blood alcohol concentration of 0.14%.
