On Thursday, June 12th, 2025 at approximately 6:15 p.m., I, Officer Campers (East 3) along with Officer Morel (East 1) were dispatched to 360 Medford Street (Mobil Mart Gas) for an unwanted male.

 

Upon our arrival, we were met with a Ms. XXXX (the shopkeeper) and Mr. Brian Minichino. MINICHINO was sitting just in front of the business on the curb (still in the parking lot of the establishment). XXXX was standing next to him and pointed at him saying "this is him, he won't leave." XXXX was very upset so I requested that she go inside and Officer Morel could follow her in to speak with her privately.

 

I then spoke with MINICHINO and asked him what happened. MINICHINO was intoxicated and began slurring his words saying "she said I said a bad word and that she wants me out of the store." I informed MINICHINO that as the shopkeeper she can request that he be removed due to his belligerent behavior. Officer Morel then came outside and said to me that XXXX wanted him removed from the property and trespassed. I then informed MINICHINO that he was being trespassed and was not allowed to come back to the store or parking lot/pumping stations.

 

I then asked him to begin gathering his belongings which consisted of a plastic bag filled with clothing and a basketball. He then began yelling saying "I didn't do anything wrong!" He then kicked the basketball up in the air, over a fence, and into the adjacent parking lot (approximately 25 feet). I asked MINICHINO what the purpose of that was and he just kept yelling at officers and accused us of discriminating against him. Officer Morel politely explained to MINICHINO once more that the shopkeeper wanted him removed off the property and trespassed and we were just here to make sure that happened. MINICHINO then pointed to the park/parking lot adjacent to the business and said "you know I live over there right I come to this store all the time."

 

We then walked MINICHINO over to the sidewalk and reiterated that he could not come back to the property or he would be arrested. MINICHINO then began taunting officers, he stepped into the parking lot placed his hands in front of his body and then stated "just arrest me then because I'm coming back." Officer Morel and I told MINICHINO to back up off the property onto the sidewalk and he continued to walk forward saying "just arrest me then, just arrest me." Officer Morel and I complied with MINICHINO's wishes and placed him in handcuffs.

 

I then went inside to speak with XXXX personally. She told me that MINICHINO was inside drinking alcohol and bothering customers to the point where several left because they did not want to interact with him. XXXX asked him to leave and he replied with "you're a bitch." XXXX then called the police.

 

Office Clancy operating marked wagon #200 arrived on scene and placed MINICHINO inside and secured him with the seatbelt. MINICHINO then began yelling inside the wagon and removed the seatbelt, he also attempted to bang his head against the door. Officers opened the wagon door and secured MINICHINO once more. Sgt. Berrouet arrived on scene and authorized Officer Clancy to go lights and sirens back to the station to expedite the process of transporting MINICHINO.

 

MINICHINO was booked in the usual manner by Lt. Fusco for the following violation:

 

M.G.L c266 s120- Trespassing
