Narrative: On Sunday, October 4, 2026, I, Officer Goodnow, was assigned to marked unit East-2. I was traveling on Prospect Street a public way in the city of Somerville. While stopped at a red light behind multiple other vehicles, I observed a Blue Honda Bearing MA Reg: XXXX move from the left-turn-only lane and cross into my lane in front of the other cars. At the time, the light was still red; I observed the blue Honda proceed through the light onto Somerville Avenue. I activated my emergency lights to conduct a traffic stop as I turned onto Somerville Ave. I observed the Blue Honda in the middle of the road in both lanes, including the opposite travel lane.
I initiated a traffic stop on the vehicle. I approached the driver, identified as Melvin Dominique. I spoke with DOMINIQUE and explained the reason for the stop. Note: During this, I could smell the odor of an alcoholic beverage emanating from the vehicle and observed DOMINIQUE's eyes to be bloodshot red and glassy. DOMINIQUE stated, I know, I know, I'm just going home. DOMINIQUE explained he lived in Wakefield as I continued to speak with him, I noticed his speech to be slightly slurred.
I explained to DOMINIQUE that he was showing signs of impairment and that I would like to conduct a field sobriety test on him. I told DOMINIQUE that he did not have to take the test and that it was completely voluntary. DOMINIQUE stated that he would submit to the test.
Throughout this encounter, I explained and demonstrated all tests.
Horizontal Gaze Nystagmus:
DOMINIQUE had equal pupil size. He did not exhibit resting Nystagmus. When asked if DOMINIQUE wore glasses or contacts, he stated yes. I asked if he was wearing contacts, and he stated no. DOMINIQUE explained that he had a concussion Four (4) years ago when asked if he had any prior injuries.
During the test, I observed a lack of smooth pursuit in both eyes. I observed Nystagmus prior to 45 degrees. I observed distinct and sustained Nystagmus at maximum deviation.
Next was the Walk and Turn:
The walk and turn is a divided attention test and was conducted on a flat surface and in a well-lit area. I further explained and demonstrated that DOMINIQUE would take Nine (9) heel-to-toe steps in a straight line and, on the ninth step, using his lead foot, take a series of small steps until he was facing the direction from which he had just demonstrated.
I instructed DOMINIQUE to get into the instructional stance as demonstrated, which he did, and he started the test without my instruction. I explained that we would start over and that he would wait for me to advise him to begin. Once DOMINIQUE started the test correctly, I observed him take 10 heel-to-toe steps instead of Nine (9), and on the Second (2nd), Fourth (4th), and Eighth (8th) steps, he walked off line and did not walk heel-to-toe correctly. On his Tenth (10th) step, DOMINIQUE failed to do the series of small steps as demonstrated to turn around, then walked Ten (10) heel-to-toe steps back. I observed him walk off line on the Sixth (6th) step on the way back.
DOMINIQUE refused to proceed with the next part of the Field Sobriety Test, which would have been the One-leg stand.
I advised DOMINIQUE that he was under arrest for the following:
MGL Chapter 90 Section 24J- OUI Liquor
I requested the transport vehicle (Unit 200) to respond to my location. Unit 200 arrived on scene and was operated by Officer N. Cicerone. DOMINIQUE was transported to the Somerville Police Department and booked in the usual manner by Lieutenant Rico Isidoro.
During the booking process, Lieutenant Isidoro advised DOMINIQUE of his rights and asked him to submit to a chemical test of his breath, to which he refused. DOMINIQUE was issued a notice of suspension for refusal to submit to the chemical test, and his license was seized.
DOMINIQUE was also cited Massachusetts Uniform Citation (T3481783), which was delivered in hand.
Respectfully submitted,
Officer Dayquan Goodnow #379
