NARRATIVE 

The following is a brief summary of facts pertaining to incident #25061014. 

I, Somerville Housing Police officer Sean Browne was dispatched to 20 River Road for a report of a witnessed hit and run. 

I arrived to meet the witness/caller Miss XXXXX. Miss XXXXX stated that she was in her apt when she heard a loud bang that sounded like a car accident. When she looked outside she saw a white colored SUV backing away from a Black colored parked vehicle. 

Miss XXXXX stated that she went outside to the location of this incident and she observed the white colored vehicle, now known to her as a Chevy bearing the Ma. Reg XXXXX slowly drive away in the direction of 80 River Road.  At that point Miss XXXXX took a look at the parked Black colored vehicle and saw what she thought was a fresh large dent in the front driver side fender. Miss XXXXX pointed in the direction where she saw the striking white vehicle travel and again gave me the Reg of XXXXX. 

I drove to the area of 70/80 River Road and observed the said white vehicle bearing the Ma. Reg of XXXXX slowly driving down towards the barrier at the end of the road. I pulled into the small dead end road and observed this vehicle stop at the end then go into reverse for several feet before coming to a stop. I put on emergency lights and exited my cruiser. 

As I walked up to the vehicle the female driver/operator exited the vehicle saying "I'm a soldier, I'm a soldier" over and over. I ordered her to return to her vehicle and to please have a seat but she would not comply but rather, while unsteady on her feet she continued to say "I'm a soldier, I know my rights." 

I radioed my location and the Reg of the vehicle that I was off with which was the original HIT and RUN suspect vehicle. I also requested an additional unit as the operator was ignoring my orders and was visibly unsteady on her feet and slurring her speech. Moments later my SHPD partner Mike Debethencourt arrived along with SPD Dayquan Goodnow badge #379. 

SPD Ofc. Goodnow began to initiate several field sobriety tests to Miss FRANKLIN. Most of these tests were observed on Ofc Debethencourts bodycam which will be provided upon request. Miss FRANKLIN did not listen to Ofc. Goodnow and spoke over him several times. She showed NYSTAGMUS while performing her test for Ofc Goodnow. 

She kept moving her head and not following his finger with her eyes only. She was argumentative while being given her instructions for the heel to toe test. She took a long deep breath before her first attempt and drifted to her right on steps 4 and 5. 

She then attempted a second time but fell off on her second and fifth steps. When instructed to do a different test of raising one of her feet six inches off of the ground while having her hands to her sides she began doing the heel to toe test again but failed on steps 2 and 3 then she just did not finish the test. 

She again began saying she was a soldier then went on a curse word riddled rant about some rapist in Haverhill while ignoring my orders to face the vehicle to be placed under arrest for OUI. 

Miss FRANKLIN was placed into handcuffs and arrested for both OUI and cited for the HIT and RUN property damage.  SPD Ofc. Keighla McAloney badge #369 arrived to assist with the pat frisk. She also assisted me with damage and inventory of the vehicle Miss FRANKLIN was operating. 

While doing so we observed fresh damage to the right front bumper which had fresh Black colored paint on it form her earlier hit and run. We will be reviewing SHA video to confirm and provide for evidence upon request. 

Also found inside the vehicle was a small near empty open container of RUBLE VODKA 200ML on the front passengers seat which was seized and will be logged into evidence at the SPD. 

Miss. TALA FRANKLIN was transported to the SPD by Unit 200 for booking in the usual manner. She will charged with the following offenses; 

1-      C 90 24J operating a motor vehicle while intoxicated. 

2-     1-90 24C leaving the scene after property damage. 

Miss Franklin was offered a breath test by SPD Ofc Ryan Westgate but she refused.
