On Saturday, September 27, 2025, while working my assigned shift in marked unit East-2, I, Officer Bitencourt, along with Officer Lorizio in marked unit East-3, was dispatched at approximately 2:06 AM to the intersection of Hunting Street and South Street for a report of a motor vehicle that had crashed into a building.

Upon arrival, I observed a grey Toyota bearing Massachusetts registration XXXX positioned on top of the curb, crashed against the building located at 47 Hunting Street. Standing next to the vehicle was a male later identified as RODNEY BANYOYA. As I approached, Mr. BANYOYA immediately stated, "a dog ran in front of the car." While conducting a closer inspection of the vehicle, I observed that the airbags had deployed and the vehicle was still in the drive gear at the time of my arrival.

While speaking with Mr.Banyoya, i observed that his eyes were glassy, his speech was slurred, and there was a steong oder of an alcoholic beverage emanating from his breath. I asked Mr. BANYOYA where he was coming from, to which he initially stated, "a birthday party in Boston." While speaking to him, I detected a strong odor of an alcoholic beverage emanating from his breath. I informed him of this observation and asked again where he was actually coming from. He then admitted he was returning from "Faneuil Hall in Boston." When asked how many drinks he had consumed, Mr. BANYOYA stated, "a few mixed drinks."

I explained the Standardized Field Sobriety Tests (SFSTs) to Mr. BANYOYA and asked if he wished to participate. He was indecisive and attempted several times to divert the conversation, repeating statements such as, "I live down the street," along with other mumbled remarks that were difficult to understand due to his slurred speech. After being asked multiple times, Mr. BANYOYA ultimately refused to participate in SFSTs. Based on my observations, he was placed under arrest for OUI Liquor.

Also present at the scene was a passenger, later identified as XXXX. Mr. XXXX stated that he and Mr. BANYOYA had been out drinking at Faneuil Hall in Boston. Mr. XXXX reported that he had consumed approximately 2 to 4 mixed drinks himself and confirmed that both he and Mr. BANYOYA had been drinking.

The vehicle involved was determined to belong to XXXX, who Mr. BANYOYA stated was his mother.

Mr. BANYOYA was transported to the Somerville Police Department located at 220 Washington Street, where he was booked in the usual manner by Lt. Kim. He was also issued a citation in addition to being charged.

The corner of 47 Hunting Street, where the crash occurred, has a camera mounted directly above the impact location. Due to the time of incident, I was unable to retrieve footage. Photographs of the vehicle and crash scene will be attached to this report. The building sustained no observable damage. Mr. BENYOYA refused a Breath Alcohol Content (BAC) test (breathalyzer). Pursuant to Massachusetts General Law, his driver's license was confiscated and will be suspended for 180 days.

Respectfully submitted,

Officer Igor Bitencourt #374
